Former President Donald Trump and his two eldest children are set to testify next month in New York Attorney General Letitia James's ongoing civil investigation into his business after the state's top court on Tuesday rejected Trump's latest attempt to avoid being deposed.
Last week, Trump, along with Ivanka and Donald Trump Jr., agreed to answer questions under oath starting July 15, unless the Court of Appeals intervened and granted his most recent appeal.
But on Tuesday, the state's high court denied Trump's appeal, arguing that its intervention in the case was unwarranted. The court also dismissed Trump's request to stay the subpoenas.
The Trump family's appeal was dismissed on "the ground that no substantial constitutional question is directly involved," the brief decision said, meaning New York State's constitution.
The Associated Press first reported the decision.
The removal of the last legal roadblock to the Trump's testimony leaves in place an intermediate appellate court's ruling last month upholding the subpoenas for the three Trumps' testimony.
A lower appellate court had ruled in May that Trump and his children must be deposed, affirming the original ruling by the state Supreme Court Judge presiding over the AG's probe finding that James and her office were within their mandate in investigating the Trump Organization and ordering the testimony of its principals.
James has previously said that her office has "uncovered significant evidence" showing Trump and his organization falsely valued multiple assets for economic benefit.
The former president has accused the three-year investigation of being a political "witch hunt." A representative for Trump did not immediately respond to Insider's request for comment.
